THREE MEN ARRESTED AND CHARGED IN KEARNY HOME INVASION

Hudson County Prosecutor Esther Suarez has released the following information:

At approximately 7:30 a.m. on December 22, 2017, the Kearny Police Department received a report of a burglary at a residence in the center of town. Responding officers found a victim who reported that several males entered her apartment demanding money, before sexually assaulting her and then leaving with her automobile.

The subsequent investigation conducted by the Hudson County Prosecutor’s Office Special Victims Unit and the Kearny Police Department, with assistance from Immigration and Customs Enforcement, has led to the arrest of three suspects involved with this home invasion.

On December 29, 2017, David Gualteros, age 21, of Newark, was arrested in Newark by members of the Hudson County Prosecutor’s Office, Kearny Police Department, Newark Police Department, and Immigration and Customs Enforcement. He has been charged with Aggravated Sexual Assault in violation of N.J.S.A. 2C:14-2, a first-degree crime; Kidnapping in violation of N.J.S.A. 2C:13-1, a first-degree crime; Robbery in violation of N.J.S.A. 2C:15-1, a second-degree crime; Conspiracy to Commit Robbery in violation of N.J.S.A. 2C:5-2 and 2C:15-1, a second-degree crime; Burglary in violation of N.J.S.A. 2C:18-2, a second-degree crime; Conspiracy to Commit Burglary in violation of N.J.S.A. 2C:5-2 and 2C:18-2, a second-degree crime; Theft by Unlawful Taking in violation of N.J.S.A. 2C:20-2, a third-degree crime; Terroristic Threats in violation of N.J.S.A. 2C:12-3, a third-degree crime; and Endangering the Welfare of a Child in violation of N.J.S.A. 2C:24-4, a third-degree crime.

On December 29, 2017, Erick Leon-Farinango, age 21, of Belleville, was arrested in Belleville by members of the Hudson County Prosecutor’s Office, Kearny Police Department, Belleville Police Department, and Immigration and Customs Enforcement.   He has been charged with Conspiracy to Commit Robbery in violation of N.J.S.A. 2C:5-2 and 2C:15-1, a second-degree crime; Burglary in violation of N.J.S.A. 2C:18-2, a second-degree crime; Conspiracy to Commit Burglary in violation of N.J.S.A. 2C:5-2 and 2C:18-2, a second-degree crime; and Theft by Unlawful Taking in violation of N.J.S.A. 2C:20-2, a third-degree crime. Additional charges against Leon-Farinango are expected to be filed.

On December 29, 2017, Evin Ferman-Argueta, age 24, of Newark, was arrested in Newark by members of the Hudson County Prosecutor’s Office, Kearny Police Department, Newark Police Department, and Immigration and Customs Enforcement. He has been charged with Aggravated Sexual Assault in violation of N.J.S.A. 2C:14-2, a first-degree crime; Kidnapping in violation of N.J.S.A. 2C:13-1, a first-degree crime; Robbery in violation of N.J.S.A. 2C:15-1, a second-degree crime; Conspiracy to Commit Robbery in violation of N.J.S.A. 2C:5-2 and 2C:15-1, a second-degree crime; Burglary in violation of N.J.S.A. 2C:18-2, a second-degree crime; Conspiracy to Commit Burglary in violation of N.J.S.A. 2C:5-2 and 2C:18-2, a second-degree crime; Theft by Unlawful Taking in violation of N.J.S.A. 2C:20-2, a third-degree crime; Terroristic Threats in violation of N.J.S.A. 2C:12-3, a third-degree crime; and Endangering the Welfare of a Child in violation of N.J.S.A. 2C:24-4, a third-degree

In addition to the Special Victims Unit, Prosecutor Esther Suarez credited the Kearny Police Department, the Newark Police Department, the Belleville Police Department, the Hillsborough Police Department, and Immigration and Customs Enforcement for assisting with the arrests.
